Introduction
These Terms and Conditions form an agreement between you and us, Finfare Rewards Ltd (referred to in this Agreement as Finfare Rewards, or "us", "we" and "our"). We recommend that you read these Terms and Conditions carefully.
By downloading any of our applications, or by registering to use, and / or accessing or otherwise using any part of our services, you agree to be bound by these Terms.
These Terms and Conditions operate alongside our Privacy Policy, and govern your access to, interaction with and use of our services, including our website, mobile application, and cashback programme(s) and any further or supplemental services we may invite you to use or participate in from time to time.
Finfare Rewards Ltd
- We operate cashback programmes and related services both in our own name, and also as reward programmes for selected clients. Whether you engage with our services directly, or upon introduction or referral to us from one of our clients or partners, you agree to be bound by these terms.

Our Services
- Our services allow you to earn cashback on transactions that you make in participating stores and venues, and / or on participating merchant's websites. This cashback forms part of a sum of money paid to us by the relevant merchant in the form of commission. For the avoidance of doubt, if, despite your use of our services, we do not receive the anticipated commission for any transaction(s) for any reason, we will have no liability to pay the cashback for that transaction(s) to you.
- We reserve the right to add, remove or change participating merchants, or methods of earning cashback therefrom, at any time and in our sole discretion. Furthermore, the rate of cashback, along with any specific restrictions or terms and conditions, may change from time to time. The current offers and terms are displayed clearly on our website, mobile application, or via the website of our selected clients. Any transaction you undertake will be subject to the published terms and conditions at the time of the transaction which may differ from those published at a sooner or later date.
- In Participating Stores -
- You must first 'link' one or more supported debit or credit cards to your account.
- When you make a purchase in a participating retail outlet using an eligible payment card which you have registered with us, software operated by us and our partners tracks and records the transaction
- When the merchant confirms that the transaction has taken place, and that any period for the transaction to be cancelled, refunded or otherwise reversed has passed, the merchant pays a commission to us - from which we allocate you a reward in the form of cashback
- Some merchants require you to 'activate' an offer prior to transacting - where this is the case, we denote this clearly
- On participating websites -
- When you visit a merchant's website by clicking through from our site, the visit is tracked using cookies and other technologies and credited to our services,
- When you make a purchase having clicked through from our site, this is tracked - provided that you complete the purchase having clicked through, in a single uninterrupted browsing session
- When the merchant confirms that the transaction has taken place, and that any period for the transaction to be cancelled, refunded or otherwise reversed has passed, the merchant pays a commission to us - from which we allocate you a reward in the form of cashback
Registering an Account and Using Our Service
- By registering an account, you confirm you are over the age of 18 and that you are resident and domiciled in the UK.
- To register an account, you agree to provide current and accurate information as is requested in order to fulfil the services to you.
- Where you register debit or credit cards for the purpose of tracking and rewarding transactions,
- you may register a maximum of 10 cards. This may include registering debit or credit cards belonging to other members of your household providing that they have consented to the registration of their cards, and that you have directed them to these terms.
- You authorise us, and our partners, including Fidel Limited to share your payment card information with Visa, Mastercard and American Express to confirm the registration of your cards and to monitor payment transactions using those cards in order to identify those transactions qualifying for a reward, and to subsequently determine eligibility for further rewards.
- If you choose to link a card(s) with your account, we provide you a secure site where you will be able to enter card information, and agree that transaction data from your card can be shared with us as well as our partners as required to operate the services. Fidel Limited or any other partner we use for the purpose are responsible for the security of processing and transmitting your card data in line with the Payment Card Industry Data Security Standard. The card data will be used in this context solely for the administration of our services. The card network or issuer will register your card on our behalf and will provide us with a different, tokenised number to act as an identifier to relate to your payment card. The sole role of the Card issuer and payment networks is to provide data from your registered card(s) to facilitate your use of the services and earning of cashback
- You may de-register one or more cards at any time, however we may continue to receive information in relation to such card(s) from the card issuer or payment network for a period of time thereafter.
- We reserve the right to de-register any or all of the cards registered to your account.
- You are responsible for ensuring the personal and financial information you provide is kept accurate and up to date.
- Each person may register one account, you may not register multiple accounts in your name. While you may occasionally make transactions for or on behalf of friends or family members, the primary purpose of the service is to undertake your own transactions. You may refer friends or family members to the service to register their own accounts, subject at all times to these terms.
- The account belongs in each instance to the owner of the email address used to register. We reserve the right to refuse or terminate an account in circumstances where these terms are not complied with.
- You are solely responsible for the accuracy of the data you submit to your account and for checking and ensuring that cashback is properly credited, and you are encouraged to check your account regularly.
- Transactions may not be confirmed immediately, and / or cashback may not properly accrue to your account during an initial period of 90 days or more. During this period, any cashback is in suspense until such time as all statutory or other permitted periods have passed within which a transaction may be reversed or refunded, including but not limited to product returns or booking cancellations. In circumstances where the qualifying transaction is reversed or refunded, some or all of the pending cashback will be removed from your account.
- Once transactions have been confirmed your account will show a balance of cashback earned. The balance does not represent sums of money held as deposits on your account - rather it represents a balance which may be converted into a payment to you if and when you request this. Where you do request this, cashback redeemed may take up to 14 days to show in your bank account.
- Neither we, nor the card networks and issuers are in any way liable for your use of your card(s) at a participating venue or elsewhere, nor for any issues you may encounter with the particular merchant or venue. Neither we, not the card networks or issuers can be liable for any errors or omissions in rewards of cashback, including but not limited to issues arising from a lack of accuracy of information we may receive from a participating merchant or venue.
- Cashback cannot be earned on card transactions made with Cards not bearing the Visa, Mastercard, or American Express logos
- You are responsible for ensuring that you comply with any terms attaching to any advertised offer. There can be various reasons that a transaction with a participating merchant or venue may not be properly detected or verified and your use of the services is subject to your acceptance that there may be transactions which are not ultimately credited with cashback. If you believe that a transaction and resulting cashback has not properly been recorded and accrued to your account, you should notify us by the help section within your account within 30 days of the disputed transaction taking place. We will then aim to research any such transactions within 30 days.
- The reasons cashback may not accrue include, but are not limited to, technical problems with electronic point of sale terminals, e-commerce systems, and / or payment processing technology. It may also be that steps required of you and provided for in the terms and conditions have not been observed. You accept that while we use reasonable care and skill to operate our services, neither we nor our participating merchants, affiliates or partners can be held liable for rewards not accruing despite our reasonable efforts. Our determination in each such matter will be final.
- Where we require your assistance in providing information in respect of a transaction or your use of any of our services, you agree to provide all reasonable information and assistance we may require, promptly and accurately.
- We further unconditionally reserve the right to not pay, or to require that cashback is forfeited where
- A commission is received by us in relation to a transaction which has not been attributed to a card or transaction linked to your account
- Commission is not received by us as anticipated from a participating merchant for any reason
- The transaction is cancelled, refunded or otherwise reversed after it takes place, for example where a product is returned
- We received a sum(s) from a merchant relating to an account which has been
- Suspended
- Associated with any fraud or breach of these terms
- Used to make purchases for other persons beyond that permitted in our discretion
- Inactive for a period of more than 12 months - inactivity is defined as the Account Holder not logging into our website or mobile application(s)
Intellectual Property and Licences
- You acknowledge that all copyright, trademarks and other intellectual property rights in and relating to our services (including material contributed by you and / or other users and by our partners) are owned by or licenced to us. You are not permitted to copy, reproduce, display or distribute, or derive material from our service or any of the material therefrom, unless properly and expressly licenced to do so by us.
- In consideration of your agreement to and continuing compliance with these Terms, and any terms incorporated by your use of any mobile application we provide, we hereby grant you a non-exclusive, non-transferable personal licence to use our services for personal, non-commercial purposes, and to create an account to do so.
Relationship with the purchases you make
- We are not a merchant, nor do we sell, supply or endorse and of the goods or services which you may purchase from merchants which we may feature on our website or mobile application(s).
- We have no responsibility or legal obligations to you arising from the quality, safety or other qualitative or legal characteristic of any goods or services promoted or provided by, and / or purchased from, participating merchants and venues.
- Our services will link from our website or mobile application to websites and services operated by third parties which are beyond our control. We are not responsible for the availability, accuracy or legality of such services, and you are solely responsible for and assume all risk arising from use of any and all such facilities, services or websites
Our Liability
- The provisions of this section will survive after suspension or termination of your account and / or this agreement for any reason.
- We warrant that we will provide our services to you with reasonable care and skill.
- In so far as we have any liability to you arising out of this Agreement it is limited to
- Our obligation to remit cashback to you where you request payment of the balance in your account with us, subject to any prevailing rules around the terms upon which such payments are remitted, and subject to the operation, as applicable, of paragraph 35 below.
- Our aggregate liability to you otherwise (regardless of how many or the type of claim(s) you bring) during any 12 month period from the date any claim is brought will be limited to the sum within that 12 month period which is the greater of a) 25% of the cashback earned, or £5.00
- Save as expressly provided for in this Agreement, we will have no liability, duty or other obligation to you, whether in contract, tort or otherwise.
- We will not be liable for any loss or damage you may incur
- Any loss of profits, revenue, business, or anticipated savings or profits
- Any indirect or consequential loss, damage, costs or other sums, howsoever arising
- resulting from any transaction with a merchant via our services
- connected to the accuracy or otherwise of content of any reviews of products or services displayed on our website or mobile application
- arising from inability to use our services, or from events beyond our reasonable control including arising from the nature of electronic transmission of data over the internet
- Save as expressly provided for in this Agreement, all representations and warranties, whether express or implied are hereby excluded, save as in the case of fraud or where prevented from such exclusion by law.
- Nothing in these terms shall limit or exclude our liability for
- Death or personal injury caused by the negligence of us, our employees, agents or subcontractors
- Fraud or fraudulent misrepresentation
Account Suspension / Termination
- You may terminate your account at any time and for any reason, by deleting your account within the website or mobile application, and / or by contacting us through the help section of your account requesting that we delete and cancel your account. Any cashback remaining in your account at the time of such termination request will be forfeited, so you are advised to withdraw any cashback before such account deletion.
- If, in our reasonable view, you are in breach of any of the terms of this agreement, we reserve the right to suspend or terminate your access to our services, or any part of them. In addition to this general right to suspend or terminate for breach of the terms of this agreement, your account will be terminated for breach of the matters at paras 36 and 37 below, and any cashback accrued to the account at the time will be retained by us in consideration for the breach.
- You must not register more than one account with us, and you must not register more than the maximum number of payment cards.
- While using the services, you must not
- Publish material to our website, mobile application or other medium which is defamatory, offensive, indecent, intended or likely to cause distress or inconvenience to any other user or any other person
- Publish material contravening any applicable law or regulation
- Publish feedback in relation to a participating merchant which is not fair or accurate
- Post advertisements or other marketing of products and services
- Submit any data or other device to our systems which contain any computer virus, or anything designed to interfere with or disrupt the operating procedures of our company or our services
Operation and Suspension of our services
- There may be reasons we need to suspend our services, or access to our systems, for planned maintenance or for other reasons, including those of a security, technical, legal or commercial basis, and we reserve the right to do so.
- Where there are to be service suspensions, we will endeavour to provide notice to you, although it may not always be possible to do so.
- We cannot and do not guarantee continued and interruption free access to our website, mobile application or our services generally. Our services may become inaccessible due to technical issues which we will use reasonable endeavours and care and skill to resolve, subject to the same being within our reasonable control.
- We may require you to change your password or other relevant security related information. We will not do so by asking you to send us your password over the telephone or by email. Maintaining confidentiality remains your sole responsibility at all times. You must notify us immediately of any unauthorised use of your account - you remain solely responsible at all times for any actions or activities taken under your account, whether authorised by you or not.
- We will not be liable for any failure or delay in performance of our obligations caused by events outside our reasonable control (Force Majeure).
Your Indemnity
- Upon demand you agree to indemnify us against any claims, expenses or other liabilities arising out of or in connection with
- Your use of the services by you or from your Account
- Your breach of this Agreement or of these terms
- Your breach of any third party right, including but not limited to intellectual property, confidentiality or privacy rights
- Any transaction you make with a participating merchant
- Any material you post or submit to our website or mobile application
Assignment
- You may not without our written consent assign ownership of your Account with us to any other person, or assign, sub contract or otherwise avoid your obligations under this Agreement. We may, and reserve the right to, assign this Agreement, and / or to assign or sub contract any of our rights and / or obligations under this Agreement, save that in so doing, we warrant that your rights and obligations will not otherwise be affected.
Entire Agreement and Version Control
- These terms, where read alongside our Privacy Policy, contain the entire Agreement between us relating to your use of, and our operation of our services. It replaces any previous agreement or version of this Agreement.
- We reserve the right to change the terms of this our User Agreement from time to time, and to publish the new version in place of the / any prior version.
- Such changes may arise from the introduction of new services or features, to comply with changes in legislation, or where a matter requires explanation or clarification. In all cases we will make reasonable efforts to let you know of significant changes. Where such changes have no adverse effect on you, this may be without advance notice and by notification within the website.
- Where we consider that a change is substantial, or where it may adversely affect you, we will provide 28 days notice by notification within the website, and may also notify you by email.
Severability, Waiver and No Agency
- In the event that any term or part of a term of this agreement is found to be invalid or unenforceable, the remainder of the term and of this agreement will remain valid and fully in force.
- In the event we elect not to enforce our rights in respect by any breach by you of this Agreement, this does not act as a waiver of that right, or of our right to enforce our rights in respect of subsequent instances of the same, or a different breach.
- There is no relationship between us of agency, partnership, joint venture or employee/employer either created or intended to be created by this Agreement.
Jurisdiction
- For the purpose of this Agreement, and of our relationship, both you and we submit to the exclusive jurisdiction of the courts of England and Wales in respect of any disputes arising therefrom which are not capable of remedy.

- Finfare Rewards Ltd is the controller of, and responsible for your personal data - referred to as "Finfare Rewards", "we", "us" or "our" in this policy. In order to provide you with a service including useful offers and cashback, we need certain data, and this policy describes how that is collected, stored and used.

Purpose of this policy
- This policy supplements our other policies, including our Terms and Conditions, to which you should also refer. Words we use have the same meaning as in the Terms and Conditions. This policy was most recently updated on 26th March 2020.
- In order to provide our service to you, we collect and process personal data. This includes any and all information you provide to create and / or administer an account with us, and / or data generated when you browse our website or make purchases with our partners, or otherwise engage with us.
- We encourage you to read this policy carefully, along with any other notices we publish from time to time, to fully understand the ways we use your data and why we do so.
- This policy deals specifically with how we process data when you are interacting with us. Our website and / or mobile application(s) will include links to external third-party websites, applications and interfaces which we do not control. We advise that you read the privacy notice(s) of such third parties, interaction with which may permit those third parties to collect and / or share your data. For the avoidance of doubt, when we refer to "third parties", "agencies" or "partners" we are referring to companies which are not part of our company, and are totally separate from us.

- Marketing Data - including information about how you use our website, mobile application and / or services, location when you did so, your preferences in receiving marketing information from us and our partners, your communications with us
- Customer Service Contact Data - includes records maintained of your contacts with us for customer care purposes, including telephone conversations, emails, live chats, social media messages or any other customer service contact method we may offer
- We also collect, store, use and share aggregate data from users of our service, such as broad demographic or statistical data, for a range of uses including internal management purposes, or to illustrate trends to partners / users or prospective partners / users. Where we do so in aggregate form in an anonymous manner incapable of identifying you, this does not take the form of personal data for legal purposes. Where we connect this in such a way that enables you to be identified, this data will be treated as personal data in accordance with this policy.

- Data received from partners providing some or all aspects of our marketing campaigns.
Account and Data Security
- When you create an account with us, a username and password is generated. We strongly recommend that you keep your username and password secret, do not allow others to use a machine or device while you are logged into the services, do not allow a shared machine to store your username or password, and sign out at the end of every session.
- All information you provide is stored securely, and any financial and / or transaction data is encrypted. The transmission of information is not completely secure, and therefore any transmission is at your own risk.
- We put in place and maintain appropriate security measures to prevent accidental loss of, or unauthorised access or disclosure of your personal data. We limit access to those employees or partners who have a need to access your data to assist in the services, and restrict to such data as is required for each function. Those parties and persons are subject to a legal and contractual duty of confidentiality and will process only upon our instructions.
- Some of our partners may be based outside the European Economic Area. If we transfer your personal data outside the UK to a country providing a different level of legal protection we put in place legally appropriate safeguards to require the protection of your personal data.
- Our procedures include those for dealing with any or any suspected data breach. At all times we are legally obliged to we will notify you and any applicable regulatory agency of any breach.
How we Use Data
- We store, process and use your personal data for the primary purposes of performing our contract with you, and where necessary for legitimate interests not overridden by your rights and interests, on the following legal bases

- Searching, identifying (or assisting a relevant partner in doing the same) and acting upon any claim for cashback which has not been captured and / or paid

- Utilising fraud prevention measures and investigating activity on our site, application or services

- We will only use your data for the purposes for which it was collected, save where it is reasonably considered necessary for a further purpose which is compatible with the original purpose. If it is necessary to process or use your personal data for a reason unrelated to the purpose for which it was collected, we will notify you of the purpose and the legal basis upon which the data is to be processed.
- Where required or permitted by law, we may process your data, including personal data, subject at all times that such processing is in accordance with the principles above.
How Long we hold Data for
- Your data will be held only for the period necessary to fulfil the purpose for which it was collected, and / or to satisfy any legal, accounting and / or regulatory purpose.
- We inform our assessment of this by reference to the original and ongoing purpose, the nature and degree of sensitivity attaching to the data, the potential risk of harm from unauthorised access or use, and whether the purposes can be achieved through other means.
- We reserve the right to anonymise personal data that we otherwise cease to hold or process in order to use indefinitely for research and statistical purposes.
- You may ask us to delete some or all of your data in some circumstances, subject to us requiring certain data to provide our services to you.
Who we Share Data with, and our Marketing to you
- We do not sell your personal data to external companies for marketing purposes. Your data may be shared with service providers who assist us with the creation and / or delivery of our marketing campaigns. Data will only be shared with a third party fort the purpose of them directly marketing to you where you have consented to this.
- We may use the data we hold about you in order to assess those of our products and services which may be most of interest to you. You will receive marketing information from us unless you have opted out from doing so. You can make changes to the marketing permissions you grant us within the website / application in which you access our services.
- It may be necessary for us to share your personal data with other parties, who at all times are required by us to respect the security of such data, and to process it only in accordance with law. Such use of data is only undertaken for purposes we specify, and upon our instruction. Those parties will include
- Affiliate networks responsible for tracking online transactions for purpose of cashback
- Payment Networks, and or Transaction platforms for tracking in store transactions for purpose of cashback
- Retailers and Merchants featured in our service where necessary to track or validate transactions as necessary to reconcile with the networks in 23(a) and (b) above.
- Providers of our IT and Systems services
- Third party email providers
- Social Media publishers
- Regulators and / or authorities where we are required to do so
- We may also disclose your personal information to prospective buyers or sellers in the event that we sell or buy any business or business assets, and / or we may transfer or assign our rights and obligations under this policy when undertaking any sale of assets.
Changing your settings and preferences
- We will provide you with relevant marketing information, including but not limited to offers and promotions which we consider to be relevant or of interest to you. We make every effort to ensure that we get the balance right between providing relevant information without providing too much information.
- Some of our communications - not of a marketing function, such as changes to services or policies, and notifications of cashback transactions - are essential and cannot be subject to opt-out save by deleting your account.
- In relation to marketing communications, each such communication will provide a link whereby you can either opt-out of receiving similar communications in future, and / or by which you can access your account settings (which can be accessed at any time) in order to assess and as necessary modify your preferences within the parameters laid out.
Your rights
- Your rights include a right to make the following requests or objections to us, for which no fee is payable, save that we may charge a reasonable fee in respect of repeated, excessive, or otherwise unfounded applications.

- 7. Access Request - making a data subject access request enables you to receive a copy of the personal data we hold about you. In responding to this and the other requests herein, we will attempt to comply within 28 days.
- Transfer Request - you may request that we provide the data you provided to us to enter into a contract with us to a third party in a readable format.
- Correction Request - subject to verification, you may request that we correct inaccurate or incomplete data.
- Processing Objection - if you feel that our processing impacts on your fundamental rights and freedoms, or for direct marketing to which you object, subject to our being able to show that our legitimate interests override those rights and freedoms.
- Deletion Request - where there is no reason for us to continue processing some or all of your data, or where you successfully objected as above, you may require us to delete your data.
